By downloading, installing, accessing, or using the BanYoo Tutor mobile application ("App"), you agree to be legally bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you must not use the App. These Terms form a binding agreement between you and BanYoo ("Company", "we", "our", "us").

BanYoo Tutor is an institution management platform that provides tools for admins and tutors to manage student enrolments, class schedules, attendance records, fee tracking, announcements, and document sharing, while students can access class information, attendance history, fee status, announcements, surveys, and uploaded documents. The App is intended for legitimate educational institutions and their registered students within India.

You must provide accurate, current, and complete information during registration and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at banyoservicesorg@gmail.com of any unauthorised use or security breach. One account per individual is permitted. You must be at least 13 years old to register, and users under 18 require parental or guardian consent.

Admins and tutors agree to use the platform only for legitimate educational management purposes, obtain necessary consents before collecting or processing student data, maintain accurate records, safeguard the Joining Code, comply with applicable Indian laws, and avoid creating fictitious students or fraudulent records.

Students agree to provide a valid Joining Code from their institution, avoid misrepresenting their identity or affiliation, refrain from registering without genuine enrolment, and keep their contact information current.

You may upload documents, PDFs, images, and files through the App for sharing within your institution community. Uploaded Content is automatically and permanently deleted 60 days from the date of upload. You are responsible for maintaining copies of important documents before that deadline. You must not upload content that is illegal, harmful, defamatory, infringing, malicious, or otherwise unlawful. We may remove content that violates these Terms. Operational records such as fee records, monthly insights, and attendance summaries may be retained for up to 12 months from creation or last relevant activity.

BanYoo Tutor records and displays fee information for informational and tracking purposes only. Subscription payments are processed exclusively through Google Play Billing. We do not collect or store sensitive payment details. We may collect a UPI ID from admin users solely to enable fee payment alerts and reminders within the App. We are not a payment processor, financial institution, or party to any financial transaction between tutors and students, and we are not liable for disputes or non-payment between users.

Certain features require an active paid subscription. Pricing and available plans are shown within the App and may change with notice. Subscription fees are collected through Google Play Billing. Cancellation takes effect at the end of the current billing cycle. Payments are generally non-refundable, and no pro-rata refund is issued for unused time. Access to paid features continues through the end of the period already paid for. Refunds are considered only for duplicate charges or demonstrable technical errors raised within 7 days at banyoservicesorg@gmail.com.

You must not use the App for unlawful purposes, attempt unauthorised access, interfere with security features, send spam, harvest personal data without consent, reverse-engineer the App, impersonate others, harass users, or use bots or scrapers to access the service.

The BanYoo Tutor App, including its source code, design, user interface, logos, trademarks, and company-created content, is the exclusive intellectual property of BanYoo and its licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the App only for its intended educational management purpose. User-generated content remains your property, but you grant us a limited licence to store, process, and display it to provide the service.

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant uninterrupted availability, error-free operation, complete security in all circumstances, fitness for your specific needs, or that any defects will be corrected.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages, loss of data, profits, or business opportunities, unauthorised access to accounts, loss of uploaded content due to automatic deletion, service interruptions, or acts of third-party service providers. Our total aggregate liability will not exceed the amount paid by you for use of the App in the 12 months preceding the claim.

You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from claims, damages, losses, liabilities, costs, and expenses arising out of your use of the App, your violation of these Terms, or your infringement of any third-party rights.

We may suspend or terminate your account if we believe you have violated these Terms or applicable law. You may request deletion of your account through the in-app option or by emailing banyoservicesorg@gmail.com from your registered address. We aim to confirm deletion requests within 7 business days after verification. Upon deletion or termination, your right to use the App ends, personal data is deleted according to our Privacy Policy, active subscriptions remain non-refundable, and surviving legal provisions remain in effect. We may modify these Terms at any time by posting revised Terms with an updated effective date. For material changes, we may provide reasonable notice through the App. Continued use after the revised Terms are posted constitutes acceptance of the updated Terms.

These Terms are governed by the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms is subject to the exclusive jurisdiction of the competent courts in India. Before initiating legal proceedings, both parties agree to attempt good-faith negotiation for 30 days after written notice.
